Knowledgeables and Answers to AAG's FAQs

Each state will have their own tier levels of court systems for county, state, regional courts They may be called by different names such as county, superior, inferior, common pleas, probate, circuit, supreme, etc.  T Understanding which courts have jurisdiction over which types of cases will help genealogy researchers learn where to find specific information.

Divorces were originally obtained from the state legislature.  Later the local or regional courts had jurisdiction over divorces. Divorce records are not considered 'vital records' even though you may find them mistakenly grouped under this term on other sites. Divorces are simply one type of legal prceedings found in court records and are considered a primary resource.. Sometimes divorce information is found in church records.  Also, the  public was notified of a divorce via publication in a local newspaper.  Thus, church records and newspapers are an alternative, secondary resource for divorce information.

A decedent's Last Will and Testament or Will is not a court record.  It is a document filed with the court after  the maker of the Will ["Testator"] dies.  The proceedings where the court deals with the Will is called Probate which is a court record.  Guardianship proceedings are also considered court records.  You will find all 3 of these in their own sections within this web site.

Oaths of Retailers:  In Georgia, The retailers pledged not to sell or give alcoholic beverages to slaves or freemen of color.

We have linked below to those transcribed records on-line that are entitled 'court records'.  It is up to each researcher to read these transcriptions in their entirety to locate specific lists and court proceedings.   We have not pointed to each individual, per person, record that has been transcribed as these are best found by a surname+location search .  If you know a site with transcribed court records, let us know.
